These Terms and Conditions (“Terms”) govern access to and use of the Hire Local website, platform, services, job listings, employer tools, communications, and related features (collectively, the “Platform”). Job-board terms of use commonly define the agreement as binding on all users, cover acceptable use, user submissions, employer obligations, disclaimers, suspension rights, and limitations of liability, and this draft follows that general structure.
By accessing or using the Platform, creating an account, posting a job, subscribing to job alerts, applying for a job, or otherwise using any part of the Platform, the user agrees to be bound by these Terms. If a user does not agree to these Terms, that user must not use the Platform.
1. Eligibility and Scope
The Platform is intended for use by individuals seeking employment opportunities, employers seeking to advertise lawful job openings, and other lawful website visitors. Job-board terms commonly limit use to those seeking employment or filling openings and prohibit unrelated or abusive uses.
Users must be at least 18 years old, or the age of majority in their jurisdiction, to create an account or use the Platform in a manner requiring legal capacity. If a user is acting on behalf of a business or other entity, that user represents and warrants that the user has authority to bind that entity to these Terms.
2. Changes to the Terms
Hire Local may update or modify these Terms at any time by posting a revised version on the Platform and updating the effective date or last-updated date. Continued use of the Platform after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
3. Account Registration and Security
Certain features of the Platform may require account registration. Users agree to provide accurate, current, and complete information and to keep such information updated. Job-board website terms consistently require truthful registration information and place responsibility on the user for maintaining account security.
Users are responsible for maintaining the confidentiality of login credentials and for all activities occurring under their accounts. Users must promptly notify Hire Local of any suspected unauthorized access or security breach.
Hire Local reserves the right to suspend, restrict, or terminate accounts that contain false information, appear misleading, violate these Terms, or create risk for the Platform or its users.
4. Job Seeker Use of the Platform
Job seekers may use the Platform solely for lawful personal employment-search purposes. Permitted use includes browsing listings, creating an account, subscribing to alerts, applying to positions, and communicating through the tools provided by the Platform.
Job seekers may not:
- Submit false, misleading, defamatory, or fraudulent information.
- Impersonate another person or misrepresent identity, qualifications, or employment history.
- Use automated means to scrape, harvest, copy, or download Platform data except where expressly authorized.
- Use the Platform to spam employers, transmit malware, collect personal information unlawfully, or interfere with Platform functionality.
- Submit content that violates any law, infringes intellectual property rights, or invades privacy rights.
5. Employer Use of the Platform
Employers and authorized employer representatives may use the Platform solely to advertise legitimate employment opportunities and manage related hiring communications. Job-board terms commonly require employer postings to be accurate, lawful, and connected to genuine hiring activity.
Employers represent and warrant that:
- They are authorized to post each listing and act on behalf of the named employer.
- Each listing relates to a genuine job opportunity.
- Listing content is accurate, lawful, non-deceptive, and compliant with applicable employment, advertising, anti-discrimination, wage, and privacy laws.
- They will not request unlawful payments, fees, investments, or purchases from applicants as a condition of hiring.
- They will not post franchise offers, pyramid schemes, distributorships, commission-only arrangements without appropriate disclosure, “business opportunities,” or any role primarily requiring up-front payment or recruitment of others.
Employers may not post false, misleading, duplicate, bait-and-switch, or abusive listings. Hire Local may request verification materials, reject listings, remove listings, delay publication, or suspend employer accounts at its discretion to maintain trust and reduce fraud risk.
6. Employer Verification and Moderation
Hire Local may, but is not obligated to, review business identity, website information, contact details, or other materials before or after approving an employer account or publishing a listing. Job-board terms and related policies commonly reserve broad moderation and enforcement rights to remove or reject content not in the best interests of the platform or its users.
Any review, moderation, or verification performed by Hire Local is a risk-reduction measure only and does not constitute a guarantee that a user, employer, applicant, listing, or communication is legitimate, accurate, safe, or lawful.
7. User Content and License
Users may submit job postings, resumes, application materials, profile information, messages, reviews, reports, and other content (“User Content”) through the Platform. Users retain rights they may have in their User Content, but by submitting User Content to the Platform, the user grants Hire Local a worldwide, non-exclusive, royalty-free, sublicensable license to host, use, reproduce, store, modify for formatting purposes, display, distribute, and otherwise process such User Content as reasonably necessary to operate, promote, secure, and improve the Platform.
Users represent and warrant that they own or control the necessary rights in their User Content and that the submission of such content does not violate any law or third-party rights.
8. Payment, Fees, and Refunds
Certain employer services may require payment, including job postings, featured listings, subscriptions, upgrades, or promotional services. Where fees apply, the employer agrees to pay all charges disclosed at the time of purchase. Job-board terms frequently include provisions requiring payment of charges and limiting the circumstances under which refunds are available.
Unless otherwise expressly stated in writing:
- Fees are quoted in U.S. dollars.
- Fees are non-refundable once a paid listing or service has gone live, except where required by law.
- Hire Local may, at its discretion, issue credits, extensions, or other remedies in place of refunds.
- Employers are responsible for all applicable taxes, chargebacks, and payment disputes related to their purchases.
Hire Local may change pricing or service offerings at any time, but price changes will not retroactively alter charges already accepted.
9. Prohibited Conduct
No user may use the Platform to:
- Violate any applicable law or regulation.
- Infringe intellectual property, privacy, publicity, or contractual rights.
- Transmit spam, chain letters, malware, viruses, bots, scraping tools, or harmful code.
- Attempt unauthorized access to accounts, servers, or data.
- Reverse engineer, disrupt, overload, or interfere with the Platform.
- Harvest or misuse personal data obtained through the Platform.
- Post content that is fraudulent, defamatory, obscene, discriminatory, threatening, harassing, or misleading.
10. Job Listings, Applications, and No Employment Guarantee
Hire Local provides a marketplace and publishing platform through which employers may advertise jobs and job seekers may discover opportunities. The Platform does not employ job seekers on behalf of third-party employers and does not guarantee the availability, quality, legality, accuracy, compensation, duration, or outcome of any listing, interview, application, or employment relationship. Job-board agreements commonly clarify that listings are provided by third parties and that use of the job board is at the user’s own risk.
Hire Local does not guarantee that any application will receive a response, that any employer will review any application, or that any user will obtain employment, interviews, or hires through the Platform.
11. Third-Party Websites and Services
The Platform may include links to third-party websites, employer career pages, applicant tracking systems, payment processors, and other external services. Website terms of use commonly disclaim responsibility for third-party content or services linked through the platform.
Hire Local is not responsible for the availability, content, privacy practices, security, or performance of third-party websites or services.
12. Intellectual Property
The Platform, including its design, text, graphics, logos, compilations, software, trademarks, and other content provided by Hire Local, is owned by or licensed to Hire Local and is protected by applicable intellectual property laws. Users receive only a limited, revocable, non-exclusive, non-transferable right to access and use the Platform in accordance with these Terms.
Except as expressly permitted, no user may reproduce, republish, sell, license, distribute, create derivative works from, or exploit any portion of the Platform without prior written permission.
13. Monitoring, Enforcement, Suspension, and Termination
Hire Local may monitor activity, review content, investigate suspected violations, and take any action it reasonably deems necessary to protect the Platform, users, and business interests. This may include refusing, removing, editing, delaying, or disabling content; suspending or terminating accounts; canceling listings; restricting access; or cooperating with law enforcement.
Hire Local has no obligation to publish any listing or retain any content for any specific period unless expressly required by law or a separate written agreement.
14. Privacy
Use of the Platform is also subject to the Hire Local Privacy Policy. Where personal information is collected, processed, or disclosed, the Privacy Policy should be read together with these Terms.
15. Disclaimer of Warranties
To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. Website and job-board terms commonly disclaim warranties regarding uninterrupted operation, accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement.
Hire Local does not warrant that the Platform will be uninterrupted, error-free, secure, or free from harmful components, or that listings, employer identities, applicant information, or communications will always be accurate, complete, current, or legitimate.
16. Limitation of Liability
To the maximum extent permitted by law, Hire Local and its owners, officers, employees, contractors, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, or employment opportunities arising out of or relating to use of, or inability to use, the Platform. Limitation-of-liability clauses are a standard feature of website and job-board terms.
To the maximum extent permitted by law, Hire Local’s total liability for any claim arising out of or relating to the Platform shall not exceed the greater of: (a) the amount paid by the claimant to Hire Local for the specific paid service giving rise to the claim during the three months preceding the claim, or (b) $100.
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so portions of this section may not apply to all users.
17. Indemnification
Users agree to defend, indemnify, and hold harmless Hire Local and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of or relating to: (a) the user’s use of the Platform; (b) User Content; (c) violation of these Terms; (d) violation of any law or third-party right; or (e) employer listings, hiring practices, or applicant representations submitted by the user.
18. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Idaho, unless otherwise required by applicable law.
19. Severability and Waiver
If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. Failure by Hire Local to enforce any provision shall not operate as a waiver of that provision or any other right.
20. Entire Agreement
These Terms, together with the Privacy Policy and any additional written policies or terms expressly incorporated by reference, constitute the entire agreement between the user and Hire Local regarding the Platform and supersede prior understandings relating to the same subject matter.
